Master Terms & Conditions

1. Definitions & Interpretation

In these terms and conditions, unless the context otherwise requires:

  1. "Terms and Conditions" means the standard terms and conditions of purchase set out in this document and includes any special terms and conditions agreed in writing between FitBodiesInc.com and the Customer.
  2. "Customer / User / Professional" means the person who makes an order for products or services via the website. This includes fitness professionals, instructors, and community members.
  3. "Products" means the services and sessions described in any order. A "Session" is a one-week teaching vacation period, generally from Sunday to Sunday.
  4. "Teaching Vacation" refers to exchange opportunities brought to members via the Fit Bodies, Inc. Travel Program.
  5. "Affiliate" refers to a community member or third party provided commission for referrals to memberships or travel programs.
  6. "Site" means the current live version of the website maintained at FitBodiesInc.com.
  7. "Hospitality Setting" means the location utilized for a teaching vacation, including resorts, ships, or related settings.
  8. "Order" means an offer by a Customer to purchase Products, memberships, or services.

2. Fit Bodies, Inc. Travel Program Terms

Fit Bodies, Inc. operates as a booking agency. We have contracted with resorts to offer qualified, certified, and currently teaching professionals to serve as independent contractors.

  1. Independent Status: All Professionals acknowledge they determine and control the methods, details, and means of their training and teaching. Fit Bodies, Inc. does not control, direct, or supervise the performance of such services.
  2. Physical Condition: Professionals represent they are in good physical condition and have no known high-risk health issues that prevent them from traveling or performing their duties.
  3. Administration Fee: This varies by resort and position. It is a service fee for processing bookings, making hotel reservations, and managing follow-ups. All transactions are final upon receipt of fees.
  4. Non-Disclosure of Fees: Professionals and companions shall not discuss administrative fees or specific program costs with resort personnel or guests.
  5. Gift Fund: Some resorts require a Gift Fund (additional fee or physical supplies) for fitness and sport equipment. This is a non-negotiable part of the booking contract.

3. Membership & Auto-Renew Policy

Membership is a requirement to view availability and book teaching vacations. <learn more>

  1. 7-Day Trial: New accounts are granted a 7-day free trial. After this period, a paid membership tier must be selected.
  2. Refund Policy: All purchased memberships are final sales; no refunds will be offered for any reason.
  3. Auto-Renew Downgrades: If you choose an auto-renew membership and later wish to downgrade to a manual level, you must:
    • Pay the manual renewal fee PLUS the difference between the discounted auto-renew price and the manual price from the previous year.
    • If you cancel your membership entirely, your account will be invoiced for the price difference from your previous year's discount (e.g., if the Travel auto-renew was $95 vs. $149 manual, a $54 invoice will be generated).

4. Data Privacy & User-Generated Content (UGC)

  1. Data Processing & Documentation: You acknowledge that Fit Bodies, Inc. collects and stores personal data, including but not limited to personal education and professional certifications, for the sole purpose of resort vetting, security clearance, and travel confirmation.   2. UGC Grant: Being active on social media is a mandatory function of the program.
    • Requirement: 2 Feed posts (excluding selfies) and 5 Instagram Stories per week using @fitbodiesinc and resort-specific hashtags.
    • License: By tagging Fit Bodies, Inc. or the resort, you grant us an irrevocable, perpetual, worldwide, royalty-free license to use, reproduce, edit, and distribute said media for marketing and promotional purposes.

5. Travel Insurance & Chargeback Waiver

FIT BODIES, INC. DOES NOT CONTROL RESORT OPERATIONS, WEATHER, OR AIRLINE DISRUPTIONS. YOU ASSUME ALL FINANCIAL RISK.

  1. MANDATORY RECOMMENDATION: Travel Insurance, Cancellation, and Medical Travel Coverage are strongly recommended. Reimbursement for disrupted travel can only be collected via a valid policy claim with a third-party insurer. View our Insurance Partners & Guide Here.
  2. Chargeback Waiver: You agree that you will not dispute, charge back, or attempt to reverse any payment made to Fit Bodies, Inc. for any reason, including resort closures, weather, illness, or airline disruptions.
  3. Penalty: Fit Bodies, Inc. reserves the right to contest any chargeback and assess a $500 administrative recovery fee to your account if a dispute is initiated contrary to these Terms.

6. Change & Cancellation Policy

  1. Change (90+ Days): Pros can change resorts or dates up to 90 days before departure for a $250 change fee per week. This fee must be paid immediately to secure a future credit.
  2. Credit Usage: Credits generated from changes are valid for travel May through October only and are non-transferable.
  3. Cancellation (< 90 Days): Any change or cancellation within 90 days of travel is a total forfeiture of all fees plus a $250 penalty. No exceptions are made for personal emergencies.
  4. Holiday Weeks: Booking of Easter, Thanksgiving, President's Week, and the last two weeks of December are FINAL SALES. No changes or credits will be issued.
  5. Replacement Pros: If you find a qualified replacement (active premium member) 90+ days before travel, the $250 change fee still applies to process the transaction.

7. Rare Occurrences & Weather Policies

  1. Resort Disruptions: If a resort is unable to host a pro due to closure, overbooking, or construction, the only method to recover expenses is through your Travel Insurance policy. Fit Bodies may offer an alternative placement at its discretion; if declined, all fees are forfeited.
  2. Hurricane Policy: Effective only if a tropical storm is upgraded to a hurricane during your travel week. Rescheduled travel must occur in the same month of the following year.
  3. Winter Storms: Check with airlines 24 hours prior. If flights are delayed, notify us immediately. No alternate weeks are offered if the resort is fully booked; arriving late to fulfill the remaining days is recommended.
  4. Zika/Health Advisories: All bookings are subject to the standard cancellation policy regardless of specific health bulletins. This includes travelers who are pregnant or trying to become pregnant.

8. Travel Advisories

All Professionals are responsible for keeping up to date with official travel advisories for their specific destination (distinguished from general regional advisories).

  1. Advisory Issued After Booking: If an advisory is added after confirmation:
    • You may choose to visit a different destination during the same scheduled week.
    • Alternatively, you will be issued a credit valid for any resort during the same month of your original travel dates.
    • If no other resort is available, the credit will be extended for an additional four weeks.
    • Notification Requirement: You must email reservations@fitbodiesinc.com within 7 days of the official bulletin to declare your intentions.
  2. Advisory Existing at Time of Booking: Normal cancellation policies apply:
    • Within 90 Days of Travel: No refunds or rollovers allowed. A $250 cancellation fee is due.
    • Outside 90 Days of Travel: You are responsible for a $250 change fee and will receive a May-October credit.

9. Travel Logistics & Compliance

  1. Customs Declaration: You must designate "Vacation" or "Leisure" on all customs forms. Designating "Business" or "Work" will result in immediate deportation to your country of origin.
  2. Arrival/Departure: Travel is Sunday to Sunday. Arriving after 5:00 PM on Monday or departing before Sunday (e.g., Saturday) without documented emergency approval will result in a $450 fine and permanent account termination.
  3. Passport: Must be valid for at least 6 months beyond your return date.
  4. Ground Transfers: Professionals are responsible for arranging and paying for ground transfers. Fit Bodies assists with partner arrangements but is not liable for third-party outcomes.

10. Professional Conduct & Intellectual Property

  1. Solicitation: Members shall not solicit or accept direct teaching responsibilities with contracted resorts. Attempting to self-negotiate leads to immediate termination.
  2. Intellectual Property: Plagiarism of website language, marketing slogans, or the use of Fit Bodies imagery to promote competitors is strictly prohibited and subject to legal prosecution.
  3. Accommodations: All professionals are placed in a standard category room. Professionals must request special needs (handicap/first floor) before booking. The professional is responsible for any price differential if an upgrade is required.

11. Companion Policies & Requirements

The Fit Bodies contract with resorts adheres to strict companion regulations. Companions must arrive and depart with the professional.

  1. No Mid-Week Changes: Resort contracts do not allow for the changing of companions during the middle of a travel week.
  2. Submission Timeline:
    • 6-Week Reminder: Reminder sent six weeks prior that companion names are due.
    • Grace Period: 7-day grace period offered following the reminder.
    • Final Deadline: Must be submitted no later than 5 weeks before departure.
  3. Late Changes & Fees: Adding or changing companions within 5 weeks of travel results in a $150 administrative fee.
  4. Professional Exclusions: Companions may not be employees of the resort chain or any neighboring hotel in the same region.
  5. Club Med Specifics (Caribbean & Canada): Companion changes prohibited after booking. All companions must check in together.

12. Non-Solicitation & Professional Ethics

  1. Direct Solicitation Prohibited: Members agree they shall not solicit or accept responsibilities directly with contracted resorts.
  2. Self-Negotiation: Attempting to self-negotiate a position is a violation of this agreement.
  3. Consequences: Violation leads to immediate termination of account and forfeiture of future opportunities.
  4. Intellectual Property: Plagiarism of Fit Bodies, Inc. property will result in immediate membership termination.

13. MANDATORY: Post-Booking Checklist

IMMEDIATELY AFTER YOU BOOK, you are required to:

  1. Verify passport expiration dates for all travelers.
  2. Confirm the resort and dates in "My Orders."
  3. Book airline tickets when the booking is "Confirmed."
  4. Review the "Trip Details" information via the button/link on your order.
  5. Upload certifications. Failure to have certs 6 months out results in automatic cancellation with no refund.

Transfers: Fit Bodies assists with arranging transfers through partners (e.g., Amstar), but is not responsible for outcomes offered by Amstar directly to you.

Expectations for Guest Instructor:

Enthusiasm: Resorts expect smiling, motivated professionals.

Punctuality: Arrive early; stay 20 mins if no show.

Performance: Your ability to return is based on resort evaluation.

Appearance: Dress professionally during class or gym time.

Conduct: Uphold a professional yet friendly demeanor.

Safety: Be aware of guest abilities, heat, and hydration.

Interaction: Follow directions and work well with staff.

Tipping: Never expected, always appreciated.

Childcare: Do not rely on the Explorer Club during class time.

14. Loyalty Rewards & Affiliate Program

  1. Loyalty Travel Rewards: Premium account holders earn points via qualified referrals.
  2. Affiliate Program: Partners may earn monetary rewards.

13. Travel Package Terms

By purchasing a Package, you agree to specific tier terms and conditions which default to general terms for FitBodiesInc.com.

14. Trademark & Copyright

All website design, text, graphics, and software are copyright. All rights are reserved. Any other use of materials—including reproduction, modification, or republication—without prior written permission is strictly prohibited.

15. Changes to Terms and Conditions

  • Reservation of Rights: Failure to enforce any provision does not waive said provision for future requirements.
  • Modification Authority: Fit Bodies, Inc. reserves the absolute right to modify these Terms at any time.
  • Immediate Effect: Modifications have immediate effect upon posting to the Site.
  • User Responsibility: Continued use of the Site constitutes conclusive acceptance of the updated Terms.

16. Legal Provisions

  1. Jurisdiction: Kenton County, Kentucky (exclusive).
  2. Governing Law: Governed by the laws of the Commonwealth of Kentucky.
  3. Attorney Fees: Prevailing party is entitled to recover reasonable attorney fees and costs.
  4. Disclaimer: Fit Bodies, Inc. does not warrant uninterrupted site functions and is not liable for failure of performance or acts of nature.
